Terms & Conditions & Privacy Policy for the supply of Goods and Associated Services by AK Fleet Solutions
 
Without notice, these terms & conditions and privacy policy may be changed at any time; it is the responsibility of the client to check these terms regularly.
 
AK Fleet Solutions uses the VDO “Tis-Web” tachograph analysis service, any client using this tachograph analysis service also agrees to the VDO terms and conditions.
 
Acceptance Of Terms Through Use
 
By using our site and services you signify your agreement to all terms, conditions, and notices contained or referenced herein (the "Terms of Use"). If you do not agree to these Terms of Use please do not use this site. We reserve the right, at our discretion, to update or revise these Terms of Use. Please check the Terms periodically for changes. Your continued use of this site following the posting of any changes to the Terms of Use constitutes acceptance of those changes.
 
Proprietary Rights
 
You acknowledge and agree that copyrights or other proprietary rights and laws protect all content and materials available on this site. Except as expressly authorised by AK Fleet Solutions, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content. 
 
Notwithstanding the above, you may print or download one copy of the materials or content on this site on any single computer for your personal, non-commercial use, provided you keep intact all copyright and other proprietary notices. Systematic retrieval of data or other content from this site to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from AK Fleet Solutions is prohibited. 
 
In addition, use of the content or materials for any purpose not expressly permitted in these Terms of Use is prohibited. As noted above, reproduction, copying, or redistribution for commercial purposes of any materials or design elements on this site is strictly prohibited without the express written permission of AK Fleet Solutions
 
Download Problems
 
Because of the numbers of different security and firewall settings, video cards and general windows settings it is impossible to solve all problems arising from these settings which prevent the program being properly downloaded or displayed. Whilst we will make every effort to solve these problems, ultimately the client may need to seek the advice of their inside I.T. Department or the suppliers of the computer or software.
 
Telephone Help 
 
AK Fleet Solutions will provide a telephone help line to include all aspects of help with the software, driver’s cards, vehicle unit, interpretation of reports and legislation, but this help must not be abused. It is not an alternative to training, where it is felt that the service is being abused a charge may be made, but the client will be advised of this beforehand.
 
 Disclaimer Of Warranties
 
All materials, information, software, products, and services included in or available through this site (the "content") are provided "as is" and "as available" for your use. The content is provided without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. AK Fleet Solutions does not warrant that the content is accurate, reliable or correct; that this site will be available at any particular time or location; that any defects or errors will be corrected; or that the content is free of viruses or other harmful components. Your use of this site is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.
 
Limitation Of Liability
 
Under no circumstances shall AK Fleet Solutions be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, this site. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if AK Fleet Solutions has been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, AK Fleet Solution’s liability in such jurisdictions shall be limited to the extent permitted by law.
 
International Use
 
AK Fleet Solutions makes no representation that materials on this site are appropriate or available for use in locations outside the United Kingdom. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
 
Data Retention
 
To use the service tachograph data is downloaded to VDO Trading servers and held there for a period of 13 months. Any data older than 13 months is automatically removed.
 
Your data will be held as long as you remain a client of the AK Fleet Solution’s tachograph analysis service. If your contract is allowed to expire all your retained data will be removed. This data removal will usually occur within 2 months of your service expiring. Neither AK Fleet Solutions nor VDO are under any obligation to keep your data.
 
"Active-X Controls" -- Programs Placed Automatically on Your Computer
 
When you subscribe to one of our Interactive Services, we may store some programs on your computer in the form of an "Active-X Control" to provide an effective service. Active-X Controls can help us in many ways; for example, by allowing us validate data entered without the need to continually transmit information. Normally you will be prompted before the control is transferred. Your Internet browser settings determine whether you receive a warning before an Active-X Control is stored. If your Network or system settings prohibit the downloading of these components then some of our services will not operate without these controls.
 
 
Fees
 
Analogue charts     -     from 30 pence per chart, for charts returned to AK Fleet Solutions for analysis.
Digital driver card     -     from 20 pence per chart, please note that the downloading of a driver card will require a card reader
TISWEB archiving    -    from 70 pence per download, please note that this is per archive download and not per chart. It is a legal requirement to archive all driver card and vehicle unit (VU) downloads
 
Because analogue charts are analysed by driver and not by vehicle, it is important that all charts submitted for analysis are delivered in driver weekly envelopes. Each envelope to display the operator's name, driver's name and the date and vehicle registration number for each chart enclosed. An addional administration charge will be made where charts are not submitted in this way  
 
Where a client would wish to analysis their own analogue charts, this service can be provided at a much-reduced fee, but note that a chart reader will be required. Please contact AK Fleet Solutions to discuss your requirements.
 
Law
 
English Law shall govern terms of Use.
 
Termination
 
AK Fleet Solutions reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.

When you access our Web sites, we may automatically (i.e., not by registration) collect information that is not personally identifiable (e.g., type of Internet browser and computer operating system used; domain name of the Web site from which you came; number of visits, average time spent, pages viewed). We may use this information and share it with our worldwide affiliates to measure the use of our Web sites and improve their content.

Customer Information
 
AK Fleet Solutions & VDO Interactive Fleet Services automatically collects information about customers using our service. We only use such data for administration purposes and so we can improve our products and services. When you sign up to use a service, or when you order one of our products we may specifically ask for information about you. We need certain information -- such as E-Mail Address, Name, Telephone number etc. in order to provide that service or product to you. We do not ask for or store credit card information on our interactive Internet services. We may also use that information to let you know of additional products and services about which you might be interested. You can choose not to receive such information if you don't want to by letting AK Fleet Solutions know by E-Mail or in writing
 
Disclosure
 
We do not use or disclose information that you may give us, such as your name, address, email address or telephone number, to any outside companies other than those who are in partnership with us in providing the service to you.
 
Security
 
AK Fleet Solutions & VDO takes precautions to ensure the security of your Information and strives to keep it accurate. We carefully protect your Information from loss, destruction, falsification, manipulation and unauthorized access or unauthorized disclosure.
 
User Names and Passwords
 
You are responsible for all use of the services made using your username and password, whether or not the use is made by you, or someone else using your username and password. You are responsible for protecting and securing your username and password from unauthorised use. If at any time you believe your username and password is being used by unauthorised persons please use the facilities provided to change your password and /or contact AK Fleet Solutions.
 
Third Party Sites
 
Our sites may occasionally have links to other sites on the Internet. These other sites are not under our control and you acknowledge that AK Fleet Solutions & VDO is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites.
